AGB's Camps

1. Conclusion of the contract

By registering for an offer from SOCCER City e.V. (hereinafter referred to as organizer), the customer offers the organizer the conclusion of a contract. Registration can be made in writing, orally or by telephone. The contract is concluded with the booking and the associated sending of the invoice, which is sent by e-mail directly after the booking.

2. Services

The scope of the contractual services results from the service description of the organizer on the brochures and the internet presentations on the page www.soccer-city.eu as well as from the information referring to this in the confirmation of participation.

3. Service and price changes

Changes or deviations of individual services from the agreed content of the contract, which become necessary after conclusion of the contract and which were not brought about by the organizer in good faith, are only permitted if the changes or deviations are not significant and do not affect the overall process. If the registration for a soccer camp / goalkeeper camp / VPC takes place up to 12 days before the start of the event, the organizer can no longer guarantee the equipment package for the camp.

4. Payment

With the conclusion of the contract and receipt of the confirmation of participation, the space is reserved and the invoice amount is due for payment. In the case of fully booked soccer camps / goalkeeper camps / VPC or trials, the order of registration and receipt of payment determine the allocation of the seats.

5. Withdrawal

a) 3-, 4-, 5-, 6- day football camps / goalkeeper camps / VPC without overnight stay/ 1-day trials without overnight stay

If you withdraw from a 3, 4, 5 or 6 day football camp / goalkeeper camp / VPC or trial that was advertised without an overnight stay, the equipment ordered will be sent to the participant and 20% of the paid participation fee will be reimbursed.

b) Football camps / goalkeeper camps with overnight stay

The customer can withdraw from the contract at any time. The withdrawal can only be declared in writing. If the customer withdraws from the contract or does not take advantage of the offer, the organizer can demand flat-rate cancellation costs as a reasonable replacement for the precautions taken and for his expenses in accordance with § 651i paragraph 2 BGB. These flat-rate cancellation costs are per registered participant at football camps / goalkeeper camps that are advertised with an overnight stay:

from registration up to the 30th day before the start of the event 20% of the order amount
from the 29th day up to the 22nd day before the start of the event 30% of the order amount
from the 21st day up to the 15th day before the start of the event 45% of the order amount
from the 14th day up to the seventh day before the start of the event 65% of the order amount
from the sixth day up to the first day before the start of the event 80% of the order amount
on the day of the start of the event 95% of the order amount

6. Cancellation and termination by the organizer

In the following cases, the organizer can withdraw from the contract or terminate the contract after the start of the event:
a) Without observing a deadline
If the participant permanently disrupts the implementation of the event despite a warning from the organizer or if he behaves in a manner contrary to the contract to such an extent that the immediate cancellation of the contract is justified. If the organizer cancels, he retains the right to the travel price, however, he must allow the value of the saved expenses as well as those advantages which he obtains from a different use of the services not used, including those which have been brought to him by the service providers amounts.
b) Up to 2 weeks before a soccer camp / goalkeeper camp / VPC
If a soccer camp / goalkeeper camp / VPC is canceled by the organizer because the minimum number of 24 participants has not been reached, the customer is immediately offered a replacement event which may be within a reasonable distance of a maximum of 40km. If the organizer cannot offer the customer a replacement event, the customer will get back the entire participation fee. If the customer refuses to take part in the replacement event, he will receive the participation fee back, minus a processing fee of € 10 per registered person.
c) Other deadlines
The organizer is at liberty to set other withdrawal periods than those mentioned in individual cases. These are to be communicated to the customer in the advertisement or in the confirmation.
d) The organizer reserves the right to send the participant home at their own expense if the rules are not complied with (e.g. drug and alcohol consumption, vandalism, etc.).

7. Liability of the organizer

As part of the due diligence of a prudent businessman, the organizer is liable for:
1. Conscientious preparation
2. the correctness of the description
3. the proper provision of the contractually agreed services

9. Limitation of liability

9.1 The contractual liability of the organizer is limited to three times the participation price,
1. insofar as damage to the participant is not caused intentionally or through gross negligence

9.2 There is also no liability for burglary or theft.

10. Insurance
Each participant must have health and liability insurance, children and adolescents through their legal guardians. The conclusion of further insurance is at the discretion of the participant.

11. Medical care

If a participant becomes ill or injured during the event, the participant or his or her legal guardians authorize the organizer to take all necessary steps and actions for safe, appropriate treatment and / or transportation to their home. If the event organizer incurs costs due to emergency medical care for a participant, the participant or his or her legal guardians declare that they will be reimbursed immediately.

12. Photo and film rights

By registering, the participants and their legal representatives declare their consent to the participants taking pictures and film recordings and distributing and publicly displaying them by the organizer - including on the Internet - without any restrictions in terms of space, content or temporal range of use and in particular also repeatedly for purposes of own or third-party advertising and for merchandising purposes. This also includes approval for distribution and display on the SOCCER City YouTube channel as well as the SOCCER City Instagram, Facebook and TikTok Accounts.

13. Place of jurisdiction

The participant can only sue the organizer at his or her seat. For actions of the organizer against the participant, the place of residence of the participant is decisive, unless the lawsuit is against general merchants or persons who have no general place of jurisdiction in Germany or against persons who have signed the contract have moved their place of residence or usual place of residence abroad, or whose place of residence or usual place of residence is not known at the time the action is brought. In these cases, the location of the organizer is decisive.

1. Abschluss des Vertrages

Mit der Anmeldung für ein Angebot des SOCCER City e.V. (nachstehend Veranstalter genannt) bietet der Kunde dem Veranstalter den Abschluss eines Vertrages an. Die Anmeldung kann schriftlich, mündlich oder fernmündlich vorgenommen werden. Der Vertrag kommt mit der Buchung und der damit 
verbundenen Zusendung  der Rechnung zustande, die direkt nach 
der Buchung via Mail versandt wird

2. Leistungen

Der Umfang der vertraglichen Leistungen ergibt sich aus der Leistungsbeschreibung des Veranstalters auf den Prospekten und den Internetdarstellungen auf der Seite www.soccer-city.eu sowie aus den hierauf Bezug nehmenden Angaben in der Teilnahmebestätigung.

3. Leistungs- und Preisänderungen

Änderungen oder Abweichungen einzelner Leistungen von dem vereinbarten Inhalt des Vertrages, die nach Vertragsschluss notwendig werden und die vom Veranstalter nicht wider Treu und Glauben herbeigeführt wurden, sind nur gestattet, soweit die Änderungen oder Abweichungen nicht erheblich sind und den Gesamtverlauf nicht beeinträchtigen.
 Erfolgt die Anmeldung zu einem Fußballcamp/Torwartcamp/VPC in einem Zeitraum bis 12 Tage vor Veranstaltungsbeginn, kann der Veranstalter nicht mehr für das Ausrüstungspaket zum Camp garantieren.

4. Bezahlung

Mit Vertragsabschluss und Erhalt der Rechnung ist der 
Platz gebucht und der Rechnungsbetrag somit zur Zahlung fällig. Bei 
ausgebuchten Fußballcamps/Torwartcamps/VPC oder Probetagen 
entscheidet die Reihenfolge der Anmeldungen und der Eingang der 
Zahlung über die Vergabe der Plätze.

5. Rücktritt

a) 3,-, 4-, 5- 6- tägige Fußballcamps/Torwartcamp/VPC ohne 
Übernachtung/ 1-tägige Probetage ohne Übernachtung

Bei einem Rücktritt der Teilnahme von 3-, 4-, 5- oder 6- tägigen 
Fußballcamp/ Torwartcamp/VPC sowie einem Probetag, das ohne 
Übernachtung ausgeschrieben war, wird dem Teilnehmer die bestellte 
Ausrüstung zugesandt und zudem 20% der bezahlten TN-Gebühr 
erstattet

b) Fußballcamps/ Torwartcamp mit Übernachtung

Der Kunde kann jederzeit vom Vertrag zurücktreten. Der Rücktritt kann 
nur schriftlich erklärt werden. Tritt der Kunde vom Vertrag zurück oder 
nimmt das Angebot nicht war, so kann der Veranstalter gemäß § 651h 
Absatz 2 BGB pauschalisierte Rücktrittskosten als angemessenen Ersatz 
für die getroffenen Vorkehrungen und seine Aufwendungen verlangen. 
Diese pauschalisierten Rücktrittskosten betragen pro angemeldeten 
Teilnehmer bei Fußballcamps/Torwartcamps, die mit Übernachtung 
ausgeschrieben sind:

Bis 30 Tage vor Campbeginn: 20% des Camppreises
29-22 Tage vor Campbeginn: 30% des Camppreises
21-15 Tage vor Campbeginn: 45% des Camppreises
14-7 Tage vor Campbeginn: 65% des Camppreises
6-1 Tag vor Campbeginn: 80% des Camppreises
Am Tag des Campbeginns: 95% des Camppreises

6. Rücktritt und Kündigung durch den Veranstalter

Der Veranstalter kann in folgenden Fällen vor Beginn der Veranstaltung vom Vertrag zurücktreten oder nach Beginn der Veranstaltung den Vertrag kündigen:
a) Ohne Einhaltung einer Frist
Wenn der Teilnehmer die Durchführung der Veranstaltung ungeachtet einer Abmahnung des Veranstalters nachhaltig stört oder wenn er sich in solchem Maße vertragswidrig verhält, dass die sofortige Aufhebung des Vertrages gerechtfertigt ist. Kündigt der Veranstalter, so behält er den Anspruch auf den Reisepreis, er muss sich jedoch den Wert der ersparten Aufwendungen sowie diejenigen Vorteile anrechnen lassen, die er aus einer anderweitigen Verwendung der nicht in Anspruch genommenen Leistungen erlangt, einschließlich der ihm von den Leistungsträgern gut gebrachten Beträge.
b) Bis 2 Wochen vor einem Fußballcamp/Torwartcamp/VPC
Wird ein Fußballcamp/Torwartcamp/VPC vom Veranstalter mangels Erreichen der Mindestteilnehmerzahl von 24 Teilnehmern abgesagt, wird dem Kunden umgehend eine Ersatzveranstaltung angeboten, die in einer zumutbaren Entfernung von maximal 40km liegen darf. Kann der Veranstalter dem Kunden keine Ersatzveranstaltung anbieten, bekommt der Kunde die gesamte Teilnahmegebühr zurück. Lehnt der Kunde die Teilnahme an der Ersatzveranstaltung ab, erhält er die Teilnahmegebühr zurück, abzüglich einer Bearbeitungsgebühr von 10 € pro angemeldeter Person.
c) Andere Fristen
Dem Veranstalter bleibt es unbenommen, in Einzelfällen andere als die genannten Rücktrittsfristen festzusetzen. Diese sind dem Kunden in der Ausschreibung oder in der Bestätigung mitzuteilen.
d) Der Veranstalter behält sich das Recht vor, bei Nichteinhaltung der Regeln (z.B. Drogen- und Alkoholgenuss, Vandalismus, etc.) den Teilnehmer auf eigene Kosten nach Hause zu schicken.

7. Haftung des Veranstalters

Der Veranstalter haftet im Rahmen der Sorgfaltspflicht eines ordentlichen Kaufmanns für:
1. die gewissenhafte Vorbereitung
2. die Richtigkeit der Beschreibung
3. die ordnungsgemäße Erbringung der vertraglich vereinbarten Leistungen

9. Beschränkung der Haftung

9.1 Die vertragliche Haftung des Veranstalters ist auf den dreifachen Teilnahmepreises beschränkt,
1. soweit ein Schaden des Teilnehmers/Teilnehmerin weder vorsätzlich noch grob fahrlässig herbeigeführt wird

9.2  Keine Haftung besteht außerdem bei Einbruch oder Diebstahl.

10. Versicherungen
Jeder Teilnehmer/ jede Teilnehmerin muss kranken- und haftpflichtversichert sein, Kinder und Jugendliche über ihre Erziehungsberechtigten. Der Abschluss weiterer Versicherungen liegt im Ermessen des Teilnehmers.

11. Medizinische Versorgung

Wird ein Teilnehmer während der Veranstaltung krank oder verletzt sich, so bevollmächtigen der Teilnehmer bzw. seine Erziehungsberechtigten den Veranstalter alle notwendigen Schritte und Aktionen für eine sichere, angemessene Behandlung und/oder seinen Heimtransport zu veranlassen. Sollten dem Veranstalter durch eine medizinische Notfallversorgung eines Teilnehmers Kosten entstehen, so erklären sich der Teilnehmer bzw. seine Erziehungsberechtigten bereit, diese umgehend zu erstatten.

12. Foto- und Filmrechte
Die Teilnehmer/innen und ihre gesetzlichen Vertreter erklären mit der Anmeldung ihr Einverständnis dazu, dass von den Teilnehmern Bildnisse und Filmaufnahmen angefertigt und durch den Veranstalter verbreitet und öffentlich zur Schau gestellt werden - auch im Internet -, und zwar ohne Beschränkung des räumlichen, inhaltlichen oder zeitlichen Verwendungsbereichs und insbesondere wiederholt auch zu Zwecken der eigenen oder fremden Werbung sowie zu Merchandisingzwecken. Dies umfasst auch die Zustimmung zur Verbreitung und zur 
Schaustellung auf dem Youtube Kanal von SOCCER City sowie dem Instagram, Facebook und TikTok Account von SOCCER City.

13. Gerichtsstand
Der Teilnehmer/die Teilnehmerin kann den Veranstalter nur an dessen Sitz verklagen. Für Klagen des Veranstalters gegen den Teilnehmer/die Teilnehmerin ist der Wohnsitz des Teilnehmers/der Teilnehmerin maßgebend, es sei denn, die Klage richtet sich gegen Vollkaufleute oder Personen, die keinen allgemeinen Gerichtsstand im Inland haben, oder gegen Personen, die nach Abschluss des Vertrages ihren Wohnsitz oder gewöhnlichen Aufenthaltsort ins Ausland verlegt haben, oder deren Wohnsitz oder gewöhnlicher Aufenthaltsort im Zeitpunkt der Klageerhebung nicht bekannt ist. In diesen Fällen ist der Sitz des Veranstalters maßgebend.
